Terms of Service
These Terms of Service ("Terms") govern your access to and use of the websites, services, and applications offered by Honest Care LLC ("Honest Care," "we," "us," or "our"). By accessing or using our service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years old, a U.S. resident, and located in a state where Honest Care, Beluga Health, and our pharmacy partner are authorized to operate. The list of available states will be displayed during sign-up. By using the service, you represent that you meet these requirements.
2. Nature of the service
Honest Care LLC is a technology platform. Honest Care is not a healthcare provider, does not practice medicine, and is not a pharmacy. Specifically:
- Clinical services are provided by Beluga Health, an independent, U.S.-licensed telemedicine medical group whose clinicians make all clinical decisions, including whether to issue a prescription.
- Dispensing of medication is performed by Rush Pharmacy, a LegitScript-certified U.S. compounding pharmacy located at 1977 Alafaya Trail #1121, Oviedo, FL 32765, holding an active state pharmacy license.
- Honest Care provides the technology, customer support, and administrative functions that make these services accessible to patients.
A prescription is not guaranteed and is issued at the sole discretion of the licensed clinician who reviews your medical intake.
3. No medical advice from Honest Care
Information on this website is for general informational purposes only and is not medical advice. Always consult a qualified healthcare provider with any questions about a medical condition or medication. Honest Care customer support cannot provide medical advice. For clinical questions about a current prescription, message your prescribing clinician through your patient portal.
4. Account responsibilities
You are responsible for the accuracy of the information you provide, including in your medical intake. Providing false information may result in denial of service and may compromise your safety. Keep your account credentials secure.
5. Payments, subscriptions & refunds
Prices are listed in U.S. dollars and are payable at checkout. Each charge bundles three components: the medical consultation (paid to Beluga Health), the dispensed medication (paid to the pharmacy), and standard U.S. shipping.
- Recurring delivery (subscription). If you select a recurring delivery option, you are enrolling in automatic refills shipped at the interval prescribed by your clinician. You will be charged on or before each refill ship date. You may cancel a recurring delivery at any time before the next scheduled refill from your account or by emailing help@honestcare.health. Once a refill has been processed by the pharmacy, it cannot be canceled or returned.
- One-time order. A one-time order is a single shipment and does not enroll you in any recurring charge.
- Refunds. The consultation portion of any charge is non-refundable once a clinician has reviewed your information. If a clinician does not issue a prescription, the product portion of the charge is refunded in full. See our shipping & returns policy for full details.
6. Prohibited conduct
- Do not share, resell, or transfer prescription medications dispensed to you.
- Do not misrepresent your identity, age, or medical history.
- Do not attempt to interfere with the security or operation of the service.
- Do not use the service for any unlawful purpose.
7. Intellectual property
All content on this website — including text, graphics, logos, and software — is the property of Honest Care or its licensors and is protected by applicable intellectual property laws.
8. Disclaimer of warranties
The service is provided "as is" and "as available." To the fullest extent permitted by law, Honest Care disclaims all warranties, express or implied.
9. Limitation of liability
To the fullest extent permitted by law, Honest Care will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles.
11. Dispute resolution & arbitration
Any dispute arising out of or relating to these Terms or your use of the service will be resolved by binding individual arbitration administered by a recognized arbitration provider, except that either party may bring an individual claim in small-claims court if eligible. You and Honest Care each waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration provision by sending written notice to help@honestcare.health within 30 days of first agreeing to these Terms.
12. Changes to these terms
We may modify these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date.
